MD Web – Terms & Conditions
These Terms & Conditions (“Terms”) apply to all services provided by MD Web. By purchasing or using our services, you agree to these Terms.
1. About MD Web
MD Web provides fully managed websites for small businesses using a website-as-a-service (WaaS) model.
MD Web is a trading name of MD Digital, operating in the United Kingdom.
Our service includes website design, hosting, and ongoing management provided on a subscription basis.
2. The Service
Website Build
A one-off setup fee of £0–£500 (depending on the selected plan) covers the initial design and build of your website.
Websites are typically delivered within 14 days once all required information has been received.
Delivery timelines may be extended if required information, feedback, or approvals are delayed.
Ongoing Subscription
An active monthly subscription of £20-£25 (depending on the selected plan) is required for your website to remain online.
The subscription includes:
- Website hosting
- Security and maintenance
- Platform updates
- Ongoing operation of your website
The subscription does not include major redesigns, additional pages, or significant structural changes unless agreed separately.
3. Website-as-a-Service (Important)
MD Web operates on a website-as-a-service basis.
This means:
- The monthly subscription is required to keep your website live
- If the subscription is cancelled or payment fails, the website will be taken offline
- The setup fee does not include lifetime hosting or permanent ownership
Think of this like any online service — when the subscription ends, the service stops.
4. Revisions & Changes
Each website build includes one (1) or two (2) rounds of revisions, depending on your plan.
Revisions are intended for reasonable adjustments to the original design and content.
Requests outside the agreed scope may require additional fees.
After launch, small content edits may be included as part of the subscription, depending on scope and availability.
5. Client Responsibilities
You agree to:
- Provide accurate and complete information.
- Ensure you have the right to use any text, images, or materials you supply
- Respond in a timely manner to feedback or approval requests
- Ensure your website content complies with applicable laws and regulations
Delays in providing information or feedback may delay delivery.
6. Payments
A 50% deposit is required upfront before work begins.
Monthly subscription payments are billed in advance.
If a subscription payment fails, we may attempt to reprocess payment before taking the website offline.
7. Cancellations
Subscription
You may cancel your subscription at any time.
Once cancelled, your website will remain online until the end of the current billing period, after which it will be taken offline.
No refunds are provided for unused time within a billing period.
Setup Fee
The setup fee is refundable only as outlined in the Money-Back Guarantee below.
8. Ownership & Use
While your subscription is active, you are granted the right to use the website provided by MD Web.
MD Web retains ownership of the underlying platform, templates, systems, and frameworks used to deliver the service.
Client-supplied content (such as text and images) remains the property of the client.
You may not resell, duplicate, or redistribute the website or underlying system.
9. Acceptable Use
You agree not to use your website for:
- Illegal activities
- Fraud, scams, or misleading practices
- Harmful, abusive, or offensive content
- Activities that infringe third-party rights
We reserve the right to suspend or terminate services if these terms are breached.
10. Limitation of Liability
To the maximum extent permitted by law, MD Web is not liable for:
- Loss of profits, revenue, or business opportunities
- Indirect or consequential damages
- Issues caused by third-party services outside our control
Our total liability is limited to the amount paid to MD Web in the previous 12 months.
11. Service Availability
We aim to keep websites online and operating reliably, but uninterrupted service is not guaranteed.
Occasional downtime may occur due to maintenance, updates, or factors outside our control.
12. Changes to the Service or Terms
We may update our services, pricing, or these Terms from time to time.
Any changes will be published on this page. Where possible, reasonable notice will be given for material changes.
13. Termination
We may suspend or terminate services if:
- These Terms are breached
- Payments are not made
- The service is misused
14. Governing Law
These Terms are governed by the laws of England and Wales.
